Welcome to the Kingfisher Destinations website. These Terms & Conditions govern your use of our website and the travel services provided by Kingfisher Destinations (Pvt) Ltd ("Kingfisher Destinations", "we", "our", or "us").
By accessing our website, requesting a quotation, making a booking, or using any of our services, you agree to be bound by these Terms & Conditions.
1. Company Information
Kingfisher Destinations (Pvt) Ltd is a Destination Management Company (DMC) based in Sri Lanka, providing inbound travel services including tailor-made holidays, group tours, hotel reservations, airport transfers, transportation, excursions, sightseeing tours, and other related travel services.
2. Booking Confirmation
A booking is considered confirmed only when:
- We have received written confirmation from the client.
- The required deposit or full payment has been received.
- A written booking confirmation has been issued by Kingfisher Destinations.
Until confirmation is issued, quotations and itineraries remain subject to availability.
3. Quotations & Prices
Unless otherwise stated:
- All quotations are provided in the currency specified in the quotation.
- Prices are based on current supplier rates and government taxes.
- Prices may change before booking confirmation due to exchange rate fluctuations, tax changes, fuel surcharges, or supplier revisions.
- Once a booking is confirmed, no price changes will apply unless requested by the client.
4. Payment Terms
Unless agreed otherwise:
- A deposit of 30% of the total tour cost is required to confirm a booking.
- The remaining balance must be paid at least 30 days before arrival.
- Bookings made within 30 days of arrival require full payment at the time of confirmation.
- Bank transfer charges and intermediary bank fees are the responsibility of the client.
- Failure to make payment by the due date may result in cancellation of the booking.
5. Cancellation by the Client
All cancellations must be submitted in writing.
Unless otherwise stated in your quotation:
- More than 30 days before arrival – Deposit is non-refundable.
- 15–30 days before arrival – 50% of the total booking value.
- 8–14 days before arrival – 75% of the total booking value.
- Within 7 days of arrival or no-show – 100% of the booking value.
Certain hotels, airlines, train tickets, permits, festivals, or special events may carry separate cancellation conditions, which will be communicated at the time of booking.
6. Changes Requested by the Client
Changes to confirmed bookings are subject to availability.
Additional charges may apply for:
- Hotel changes
- Date changes
- Flight or train amendments
- Additional passengers
- Changes to itineraries
Kingfisher Destinations will advise any additional costs before confirming the amendment.
7. Cancellation or Changes by Kingfisher Destinations
In rare circumstances, we may need to modify or cancel services due to circumstances beyond our reasonable control, including:
- Natural disasters
- Political unrest
- Government restrictions
- Pandemics
- Road closures
- Severe weather
- Supplier insolvency
- Force majeure events
Where possible, we will offer:
- An alternative service of similar value;
- A revised itinerary; or
- A refund for services that cannot be provided.
8. Travel Documents
Clients are responsible for ensuring they possess:
- A valid passport
- Appropriate visas
- Required vaccinations
- Health documentation
- Travel insurance
- Any permits required for travel
Kingfisher Destinations accepts no responsibility for denied boarding or entry due to incomplete documentation.
9. Travel Insurance
We strongly recommend that every traveller obtains comprehensive travel insurance covering:
- Medical emergencies
- Personal accidents
- Trip cancellation
- Flight delays
- Lost baggage
- Personal liability
- Emergency evacuation
Travel insurance is the responsibility of the traveller.
10. Health & Fitness
Travellers should ensure they are medically fit to participate in their chosen itinerary.
Any medical conditions, allergies, dietary requirements, mobility limitations, or disabilities should be disclosed before booking so that reasonable arrangements can be considered.
11. Wildlife & Responsible Tourism
Kingfisher Destinations is committed to responsible tourism.
We do not promote activities involving animal cruelty or exploitation.
Guests are expected to:
- Respect wildlife.
- Follow park regulations.
- Avoid feeding wild animals.
- Respect local customs and traditions.
- Protect cultural and natural heritage.
12. Third-Party Suppliers
Hotels, airlines, transport providers, guides, restaurants, and activity operators are independent suppliers.
While we carefully select our partners, Kingfisher Destinations acts as an intermediary for many services and cannot accept responsibility for failures or omissions by third-party providers beyond our reasonable control.
13. Limitation of Liability
Kingfisher Destinations shall not be liable for any indirect or consequential loss arising from:
- Flight delays
- Airline cancellations
- Weather conditions
- Government actions
- Force majeure
- Theft
- Personal injury
- Illness
- Loss of baggage
- Acts or omissions of third-party suppliers
Our liability shall not exceed the amount paid directly to Kingfisher Destinations for the affected services, except where liability cannot legally be excluded.
14. Website Use
You agree to use this website only for lawful purposes.
You must not:
- Attempt unauthorized access to our systems.
- Copy website content without written permission.
- Use our content for commercial purposes without consent.
- Upload malicious software or harmful code.
All website content, logos, photographs, graphics, and text are the intellectual property of Kingfisher Destinations unless otherwise stated.
15. Privacy
Personal information collected through our website or during bookings will be handled in accordance with our Privacy Policy.
Information may be shared only with suppliers necessary to provide your travel arrangements.
We do not sell personal information to third parties.
16. Intellectual Property
All trademarks, branding, logos, photographs, itineraries, designs, brochures, and website content remain the property of Kingfisher Destinations unless otherwise stated.
Unauthorized reproduction is prohibited.
17. Governing Law
These Terms & Conditions shall be governed by the laws of the Democratic Socialist Republic of Sri Lanka.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
